Betavine Intellectual Property

Intellectual Property Rights (IPR) are always a bit of a tricky issue, but we thought you'd appreciate a brief guide on how we deal with IPR on Betavine:

We ask of you In our website Terms (which apply to the hosting of your applications on Betavine) we have included an Intellectual Property Rights clause which states:

7.13 The IPR in Your Submissions themselves shall remain owned by You (or your licensor(s), as appropriate).
7.14 You grant to Vodafone a worldwide, non-exclusive and royalty-free licence to use, operate, copy, host and otherwise deal with Your Submissions for the purpose only of allowing End Users to download Your Submissions from the Site under the relevant Licence(s).

We also allow our developers to decide which licence they want to attach to their applications - and we even provide an optional licence (the Software Download License for non-Vodafone Apps) if you don't have your own to hand. This "standard" licence contains an Intellectual Property Rights clause which requires the downloader of the application to accept before they proceed:

5 You acknowledge that any and all of the copyright, trade marks, trade names, patents, database rights and other intellectual property rights subsisting in or associated with the Software (including without limitation all relevant documentation and manuals) are and remain the Provider's or Vodafone's property, or that of their licensors (as appropriate).

Naturally, we have our own Intellectual Property Rights with regards to the website itself and the use thereof. You can find our IPR clause in the Betavine Terms of Use, which apply to your use of the website.

Getting Advice on Intellectual Property Rights

There are lots of helpful organisations which can provide useful information on protecting your IPR - such as the Chartered Institute of Patent Agents or the UK Patent Office. For those outside of the UK, there are many such organisations around the world.

What is Intellectual Property

The definition of Intellectual Property according to the World Intellectual Property Organization is: "creations of the mind - inventions, literary and artistic works, symbols, names, images, and designs used in commerce.

IP includes but is not limited to proprietary formulas and ideas, inventions (products and processes), industrial designs, and geographic indications of source, as well as literary and artistic works such as novels, films, music, architectural designs and web pages."
